1. Acceptance of These Terms
By accessing our website or engaging our services, you confirm that you are at least 18 years of age and able to enter into a binding agreement. If you do not agree with these Terms, please do not use our website or book our services.
A separate inspection agreement may be provided and signed before an inspection takes place. Where that agreement and these Terms address the same subject, the signed inspection agreement governs that inspection.
2. Services We Provide
We provide visual home inspection and related services to clients across Saint John and Southern New Brunswick, including Hampton, Rothesay, Quispamsis, Sussex, and surrounding areas. Our services may include:
- Buyer home inspections and pre-listing inspections
- Multi-unit, multi-family, commercial, and new construction inspections
- Thermal imaging, drone roof inspections, and sewer scope inspections
- Radon testing and WETT inspections of wood-burning appliances
- 360 virtual tours and same-day inspection reports
The specific services included in your booking are described at the time you book and in your inspection agreement.
3. Scope and Limitations of Inspections
A home inspection is a visual, non-invasive examination of the readily accessible systems and components of a property on the day of the inspection. It is conducted in accordance with recognized Canadian standards of practice. An inspection reflects the condition of the property at the time of the inspection only.
An inspection is not:
- A warranty, insurance policy, or assurance of future condition or performance
- A code-compliance, engineering, or environmental survey
- An inspection of concealed, inaccessible, or unsafe-to-access areas
- A prediction of the remaining life of any system or component
We do not move furniture or stored items, dismantle equipment, or access areas that are locked, blocked, or hazardous. Conditions can change after the inspection, and some defects may not be visible or detectable during a single visit.
4. Booking, Scheduling, and Property Access
When you book, you agree to provide accurate contact and property information. You are responsible for arranging access to the property for the scheduled inspection, including keys, lockbox codes, or the presence of an authorized person.
- Utilities (electricity, water, heating fuel) should be on and connected so systems can be tested
- If access cannot be provided or utilities are off, we may be unable to inspect certain systems and a re-visit fee may apply
- You confirm that you have the authority to authorize an inspection of the property
5. Fees and Payment
Fees are based on the service selected, the size and type of property, added services, and travel where applicable. The price presented at booking is itemized and reflects the services requested.
- Payment is due as set out in your booking or inspection agreement, typically on or before the day of service
- Payments are processed through trusted third-party payment processors; we do not store full card details
- Prices may change for future bookings, but the price confirmed for your booking will not change unless you add or remove services
6. Cancellation and Rescheduling
We understand that real estate timelines move quickly. If you need to cancel or reschedule, please contact us as early as possible by phone, text, or email. We will work with you to find a new time. Repeated short-notice cancellations or missed appointments where access could not be provided may be subject to a fee, which we will communicate to you in advance.
7. Inspection Reports
We aim to deliver a photo-rich, detailed report the same day as the inspection. The report is prepared for the client who ordered the inspection and reflects our observations and opinions at the time of the inspection.
- The report is for your use and is not transferable to other parties without our consent
- With your consent, we may share the report with your real estate professional or others involved in your transaction
- Reliance on the report by anyone other than the client is at their own risk
Post-inspection support is included at no extra charge. You are welcome to call, text, chat, or email with follow-up questions about your report.
8. SMS and Text Messaging
We offer text messaging to keep you informed throughout your inspection. This program is transactional and customer-service oriented. It is not a marketing or promotional program.
What we send
Messages relate to your inspection and account, and may include booking confirmations, contract and payment links, scheduling and access details, appointment reminders, report delivery notifications, and replies to your questions.
How you opt in
By providing your mobile phone number when you book an inspection, either online at www.theinspectors.ca/book or by phone, you consent to receive transactional text messages from us at that number. You may also opt in by texting us directly.
Message frequency, rates, and devices
- Message frequency varies based on your inspection and the activity on your account
- Message and data rates may apply, depending on your mobile carrier and plan
- Supported carriers and devices may vary, and carriers are not liable for delayed or undelivered messages
How to opt out or get help
You can opt out at any time by replying STOP to any text message from us. After you reply STOP, we will send one confirmation message and will not send further texts unless you opt in again. For help, reply HELP or contact us at (506) 651-9461 or jonathan@theinspectors.ca.
Your privacy
We do not sell or share your mobile phone number or text-messaging consent with third parties or affiliates for their marketing purposes. Information you share with us by text is handled in accordance with our Privacy Policy.
9. Email and Electronic Communications
By providing your email address, you agree that we may send you transactional emails relating to your booking, payments, and reports. With your consent, we may also send newsletters or educational content. You can unsubscribe from non-transactional email at any time using the link in those messages or by contacting us.
10. Intellectual Property
The content on www.theinspectors.ca, including text, graphics, logos, photographs, and reports, is owned by or licensed to East Coast Home Inspection Ltd and is protected by applicable intellectual property laws. You may use your inspection report for your own purposes. You may not copy, republish, or use our website content for commercial purposes without our written permission.
11. Disclaimers and Limitation of Liability
Our services are provided with reasonable care and skill and in accordance with recognized standards of practice. To the fullest extent permitted by law, our website and any general information on it are provided on an "as is" basis without warranties of any kind.
Where any liability cannot be excluded by law, our total liability arising from or relating to an inspection is limited as set out in your signed inspection agreement. Nothing in these Terms limits liability that cannot be limited under applicable law.
A home inspection reduces, but does not remove, the risks of property ownership. It is one tool to help you make an informed decision.
12. Indemnification
You agree to indemnify and hold harmless East Coast Home Inspection Ltd and its representatives from claims, damages, or expenses arising from your misuse of our website, your breach of these Terms, or your provision of inaccurate information that affects our ability to perform the service safely and properly.
13. Governing Law
These Terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there, without regard to conflict-of-law principles. Any dispute relating to these Terms or our services is subject to the courts of New Brunswick.
14. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above. Continued use of our website or services after changes take effect indicates acceptance of the updated Terms.
